An Attorney for Class Action Lawsuits

If you have been injured in a scenario that could have injured others in the same way, you may consider becoming the lead plaintiff in a class action lawsuit.

A class action lawsuit is possible when one or more people take legal action on behalf of a larger group of people, who are referred to as “the class” in the lawsuit. This approach is preferred when the number of people affected by the alleged negligence is too high to reasonably bring them all together before the court.

Class action litigation may relate to a number of issues, including:

  • Defective prescription or over-the-counter drugs
  • Mislabeled food or cosmetic products
  • Defective or dangerous consumer products
  • Fees related to banking, credit cards, or cell phones
  • Insurance company claims
  • Employment discrimination (racial, age, or gender)
  • Pension fraud
  • Environmental disasters

Class action lawsuits are initiated when there are too many people involved to file individual lawsuits. These lawsuits provide an efficient way to settle legal issues.

One of the more interesting and important roles class action lawsuits play involves preventing companies from spreading liability so thin that individual lawsuit payouts would not be high enough to make it practical for each person to file. In those instances, a class action brings all affected parties together to amass a sum that will hold responsible parties suitably accountable.

If a lawsuit is certified as a class action, the court orders that class members be notified. This is done through the mail or online. In most instances, anyone who is affected will be included in the case unless they choose to opt out.

Conveniently, class members don’t get involved directly in the case unless they have evidence to contribute. The lead plaintiff consults with the attorney(s) conducting the case, accepting or rejecting settlement offers. When a settlement offer is reached and agreed upon, the court decides how to divide the compensation at the end of the case
